1. Introduction and Acceptance

Welcome to Qurrl.ink. These Terms and Conditions (“Terms”) govern your access to and use of the Qurrl.ink website, services, and applications (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Qurrl.ink provides URL shortening, QR code generation, and link management services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Definitions

“User” refers to any individual or entity that accesses or uses the Service.

“Short Link” refers to the abbreviated URL created through our Service that redirects to a destination URL.

“QR Code” refers to the machine-readable matrix barcode generated by our Service.

“Free Tier” refers to the basic service level available at no cost.

“Premium Tier” refers to the paid subscription service offering enhanced features.

3. Service Description

3.1 Free Tier Services

Free Tier users may create shortened URLs and basic QR codes subject to usage limits. Free Tier links and QR codes may expire after a designated period of inactivity or as determined by our content retention policies. We reserve the right to modify Free Tier limitations at any time.

3.2 Premium Tier Services

Premium Tier subscribers ($10/month) receive access to enhanced features including: custom QR codes with logo branding capabilities, custom subdomain redirects, extended link retention, increased usage limits, priority support, and advanced analytics. Premium features are subject to change with reasonable notice.

4. Account Registration and Security

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

5. Acceptable Use Policy

You agree not to use the Service to shorten, redirect, or generate QR codes for URLs that:

Contain malware, viruses, or other malicious code
Facilitate phishing, fraud, or deceptive practices
Distribute illegal content or promote illegal activities
Infringe on intellectual property rights of others
Contain adult content without proper age verification
Promote hate speech, violence, or discrimination
Violate any applicable laws or regulations
Attempt to circumvent our security measures or rate limiting

We employ automated security measures including malicious URL detection, bot protection, and rate limiting. Violations may result in immediate termination of service without refund.

6. User Content and Links

You retain ownership of any destination URLs you submit to our Service. However, by using the Service, you grant us a limited, non-exclusive license to process, store, and redirect your submitted URLs as necessary to provide the Service.

We do not assume responsibility for the content of destination URLs. You are solely responsible for ensuring your linked content complies with all applicable laws and these Terms.

7. Payment Terms and Billing

Premium Tier subscriptions are billed monthly at $10 USD. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. We reserve the right to change pricing with 30 days’ notice to existing subscribers.

8. Intellectual Property

The Service, including its design, features, and content (excluding User content), is owned by Qurrl.ink and protected by intellectual property laws. The Qurrl.ink name, logo, and branding are our trademarks. You may not use our trademarks without prior written consent.

Premium users uploading logos for QR code customization represent and warrant they have the right to use such logos and grant us permission to incorporate them into generated QR codes.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any damages resulting from the use or inability to use the Service, including but not limited to lost profits, data loss, or business interruption.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Qurrl.ink, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) the content of URLs you shorten or QR codes you generate.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Links created under your account may be deactivated. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.

You may terminate your account at any time by contacting us or through account settings. Termination does not entitle you to any refund of fees paid.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against us.

15. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Qurrl.ink regarding the Service and supersede all prior agreements and understandings.
